Terms of sale

1. Purpose

These terms of sale (TOS) govern the sale of the licence for the NAS Ranger software by NasRanger.com (hereinafter "the Publisher") to any person making a purchase (hereinafter "the Customer"). Any order implies unreserved acceptance of these TOS.

2. Product

NAS Ranger is a desktop application (Windows, macOS, Linux) for detecting duplicate files on a NAS and importing only new files. The product is supplied as a licence to use, and not sold: the Customer acquires no ownership right over the software.

3. Price and payment

The price of the licence is €39 incl. VAT (unless a promotion is in effect). Payment is processed by Polar Software, Inc., the official reseller ("Merchant of Record"), which issues the invoice, collects and remits the VAT applicable in the Customer's country. The accepted payment methods are those offered by Polar. Polar also processes the refunds provided for in article 6.

4. Licence of use

• The licence is personal and non-transferable.
• It allows activation on a maximum of 3 simultaneous devices belonging to the Customer.
• It is granted perpetually for the purchased version, including updates under the terms communicated by the Publisher.
• Any resale, sharing or circumvention of the activation limits is prohibited and may result in revocation of the licence.

5. Delivery and activation

After payment, an account is created using the email address provided. The Customer downloads the application and activates it using a one-time code received by email. Access to the product is thus provided immediately after purchase.

6. Right of withdrawal and refunds

A consumer Customer has 14 days from purchase to withdraw, without giving any reason and at no cost (articles L221-18 et seq. of the French Consumer Code). This right applies even if the licence has been activated and used: the Publisher does not ask the Customer to waive it.

To exercise it, the Customer sends a clear statement to contact@nasranger.com before the period expires, giving the email address used for the purchase and, if possible, the order number. A simple email is enough; the Customer may also use the withdrawal form below, but is not required to.

The refund covers the full price paid. It is made by Polar, the official reseller, to the payment method used for the order, no later than 14 days after the request is received. The time it takes to appear on the Customer's account then depends on their bank.

The refund ends the licence: it is automatically deactivated on all devices and the paid features are no longer available. The free version remains usable. If a payment is disputed with the bank (chargeback), the licence may be suspended until the dispute is closed; the Customer is therefore invited to contact the Publisher first, who handles any request made within the 14-day period without formalities.

A free version, with no account and no time limit, lets the Customer check before buying that the software meets their needs and works with their hardware. After the 14-day period, the licence is no longer refundable, except under the legal warranties described in article 7.

7. Legal warranties

Independently of the right of withdrawal, the Customer benefits from the legal warranty of conformity for digital content (articles L224-25-12 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a lack of conformity, the Customer may have the software brought into conformity or, failing that, obtain a price reduction or termination of the contract with a refund, including after the 14-day period.

8. Liability

The Publisher is liable for direct damage resulting from a breach of its obligations, under the conditions provided by law. NAS Ranger is an aid: it finds duplicates, but any deletion, move or import of files remains the Customer's decision. The application is designed to be non-destructive (detection is separate from any action on files); the Customer is nevertheless responsible for keeping a backup of their data before any operation. The Publisher is not liable for data loss resulting from the absence of a backup, an action decided by the Customer, a failure of the NAS, the network or third-party hardware, or force majeure. Nothing in these TOS deprives a consumer Customer of the rights granted to them by law.

9. Personal data

The processing of personal data is described in the privacy policy.

10. Governing law and disputes

These TOS are governed by French law. A consumer Customer residing in another country retains the benefit of the mandatory provisions of the law of their country of residence.
